REGULATION OF ACCESS TO THE ORHIDEEA SPA HEALTH CENTER

Hours: Monday – Friday, 7.00 – 22.00 (last access time 21.00), Sunday 9.00 – 22.00 (last access time 21.00), closed on Saturdays. Children can stay in the center until 20.00 (the last access time is 19.00). On public holidays or non-working days decided by the Romanian Government, the center’s program is similar to Sunday’s program. Exceeding the time limit of the right of access is paid at the exit from the center. The price of the overtime is 100 lei / non-breakable hour.

Access to the center areas is based on a bracelet. The bracelet is resistant to water and high temperatures. The bracelets are disinfected after each wear. Wearing this bracelet is mandatory. OH&S staff have the right to request the presentation of a bracelet to a member who does not have the bracelet displayed. The cost of replacing the bracelet, in case of loss or damage, is 50 lei.

Customer access to the OH&S center is at their own risk. OH&S cannot be held liable for any moral or material damages caused to members or third parties unless it is proven that it is the sole fault of the center.

Customers do not have access to staff areas. At the same time, members are strictly forbidden to use the controls for the use of the ventilation / air conditioning system, sound system or lighting. Touching electrical wires, even if they fall to the ground, is strictly forbidden.

The OHS Center reserves the right to request members to present, upon departure, personal luggage and its contents.

Children’s access to the center is allowed only until 20.00 (last access time 19.00), except for special programs for children and only accompanied by an employee of the center.

For children up to 4 years old, it is mandatory to use absorbent diapers for public swimming pools. The center can claim material damages in the amount of 5,000 lei (the cost of changing the water) in the event that a child meets his physiological needs in the pool or in its annexes. If the members refuse to pay these damages, the center is entitled to terminate the contract and apply to the courts for damages.

Children under the age of 16 do not have access to the therapy area (spa area) and the fitness or medical recovery area, except in the case of programs developed by the OHS center and addressed especially to children.

In the Ice & Fire area (hammam, saunas, tropical shower) children’s access is strictly forbidden, except on Sundays and public holidays between 9 and 20, only accompanied by an adult. Children under the age of 16 are not allowed in the pool area without parental supervision, except for programs specifically for children and which involve their supervision by spa staff.

Behavior of members in the center. Members undertake not to create incidents within the center which could result in moral or physical damage as well as any other inconvenience to anyone (violence, inappropriate language, offensive attitude).

Smoking (including electronic cigarettes), alcohol, drugs, drugs or illegal substances are prohibited in the center. Consumption of food in the following areas is strictly forbidden: saunas, salt mine, pool area (including relaxation area), tepidarium, locker rooms, sports area or medical recovery.

Towels, bathrobes and slippers rented from the center will be returned upon leaving the center.

Carriage. Customers are required to wear appropriate equipment for each area of ​​the Orhidee Spa.

Therapeutic pools. The outfit at the therapeutic pools is done in a bathing suit, slippers and a bathrobe. In order to avoid any misunderstandings, for reasons of public health, access to swimming pools or saunas with full suits (even if these costumes may be allowed in other geographical areas or if they comply with religious norms) is prohibited. The swimsuit consists of briefs or shorts for men; briefs, bra or body suit for women (uncovered arms and legs).

It is forbidden to access pools with leisure coils, rafts, floating mattresses or any other swimming equipment (swimming paws, palms, diving equipment, etc.).

The pools are not intended for swimming or performance training. The destination of water pools is medical treatment and relaxation.

During the week, aquagym sessions take place in the pool. To prevent congestion, please inquire at the reception about the program of aquagym classes.

The pool has a maximum depth of 1.55 m and is not supervised by a lifeguard. Access to the pool is at the user’s own risk. For safety reasons, jumping into the pool is strictly forbidden.

Saunas. Access to the saunas is without a bathing suit, only with the special sauna towels available in the center (Turkish pastries).

Clients are warned that nudism can be practiced in the sauna area and declare that they assume any physical or moral damage suffered by accessing a nudism area or an area with high temperature or humidity.

Fitness or medical recovery areas. The outfit in the fitness or medical recovery areas is done exclusively with complete sports equipment (sports shoes, pants and sports shirt) throughout the use of the medical recovery area, fitness. It is forbidden to enter with dirty shoes or in costumes that are not accepted by the center. People who are completely or partially naked, in bathing suits or in street suits are not allowed.

The Orchid Sport area is intended for sports and fitness activities organized under the supervision of qualified personnel.

The medical recovery area is intended for medical treatments performed by specialized personnel under the guidance of specialists. Access to the medical recovery area is only allowed to people undergoing medical treatment and only accompanied by OH&S staff.

Group or individual programs with a coach or therapist are made only on the basis of prior appointment at the reception. The center cannot be held responsible for the cancellation of medical or fitness recovery sessions (aerobics, spinning, etc.) due to lack of participants, motivated lack of instructor or technical failures of the facilities.

Changing rooms. In the locker room, members can occupy a single compartment for storing clothes. If a member occupies more than one locker room assigned to the reception, the spa operator reserves the right to open locker rooms occupied without right, in the absence of the owner of the goods, to seal the goods found in the occupied locker room and to hand them over to the owner only. after concluding a handover report in which the member declares the goods in the abusively occupied compartment, their description and after paying a fee of 50 lei.

The center is not responsible for the personal belongings of customers in locker rooms or other areas of the spa that have not been expressly handed over at the reception (based on a handover report). The personal belongings of the members in the locker room area, which are not stored in the personal box, are considered abandoned and will be collected by the employees of the center for 15 days after which they will be considered waste.

The center reserves the right to open any locker room in the following situations: a theft has been reported, in case of fire, there is a suspicion that in one of the compartments there are flammable, explosive or chemical products, at the request of law enforcement, damage to thermal, sanitary or electrical installations that require immediate intervention at the cabinet, other special situations.

After use, towels, bathrobes and slippers will be collected in the container at the exit of the locker room.

Precautions. Clients are required to seek the advice of their personal physician before using the therapies or equipment in the center. In particular, customers will fill out a medical history form before using the fitness area, hammam or spa, in case of therapies, but this form does not exonerate the obligation of the members to assume responsibility for the use of the center’s facilities.

Customers agree that OHS does not assume any responsibility for injuries that may occur inside the center.

Customers are warned that in wet areas (swimming pools, saunas) as well as in adjacent areas (stairs, hallway) the floor may become slippery.

Photography and filming are prohibited inside the center, unless they are approved by the OHS management.

Smoking (including electronic cigarettes), alcohol, drugs, drugs or illegal substances are prohibited in the center. Consumption of food in the following areas is strictly forbidden: saunas, salt mine, pool area (including relaxation area), tepidarium, locker rooms, sports area or medical recovery.

It is strictly forbidden, and is sanctioned with the termination of the membership contract or with the evacuation from the center, the provision by clients of swimming lessons, fitness training, medical recovery or massages to other clients, regardless of the relationship with them.

Personal data are processed by the Orhideea Spa Health Foundation, based in Bucharest, Calea Plevnei 145B, SPA, sector 6, in the following situations. At the same time, all the legal mentions we refer to below are in EU Regulation 679/2016.

The name, surname and personal numerical code and data regarding the identity document and signature are personal data that we collect in order to draw up membership contracts, service contracts or fiscal documents [GDPR, Art. 6, para. (1), lit. c)]. At the same time, we collect the data of the accompanying members of the membership contracts in order to keep records on the persons who benefited from our medical services or who were members of our center. These data are collected, processed and stored for at least 10 years according to the tax provisions in force. Data holders may not request the deletion of such data but only their rectification and restriction. These data are accessed by our authorized employees, external providers of center administration services, legal services, financial services, correspondence services and IT and archiving services. This data may be stored in encrypted format in another Member State.

Correspondence address, telephone number, email address are personal data that we collect, with your consent, for marketing purposes as well as for the purpose of transmitting urgent information about the modification of the operating program [GDPR, Art. 6, para. . (1), lit. a)]. Holders may request, during the termination of the membership contract, that their address not be used for marketing purposes. However, as long as you are a member of our center and 3 years thereafter, you cannot request the deletion of the above data that will be used in legal communication situations (debit notifications). You can request the rectification or restriction of this data. These data are accessed by our authorized employees, external providers of center administration services, advertising services, correspondence services and IT and archiving services. In certain situations we may disclose this data to legal service providers. This data may be stored in encrypted format in another Member State.

The photo of the member card holder as well as of his contractual companions is used in order to issue the membership card by consent [GDPR, Art. 6, para. (1), lit. a)]. We can issue, at your request, a membership card without a photo. In this situation, every time you access the services of our center you will have to identify yourself with an official document. We store your photo during the existence of the contractual relations and for another 12 months after that. You can request that the photo be deleted, rectified, or restricted at any time. Our employees, external providers of center administration services and IT and archiving services have access to this data. The photography is not done with special equipment that can allow the unique identification or authentication of the person, not being a collection of biometric data. This data may be stored in encrypted format in another Member State.

In the case of health and relaxation programs, we collect, process and store health data and biometric data.

Health data and biometric data are used in the health services we provide [GDPR, Art. 9, para. (2), lit. b) and h)]. The data is stored for 10 years. You cannot request the deletion of this data. You can request their rectification or restriction. These data are accessed by our authorized employees, external providers of health services (doctors, therapists), providers of center administration services and IT services and archiving. In certain situations we may disclose this data to legal service providers. This data may be stored in encrypted format in another Member State.

In the case of sports programs we sometimes collect, process and store data on your health and biometric data as well as data on your eating and social behavior.

We use data on health, biometric data and data on your eating and social behavior especially in personal training programs where we follow, together with you, the achievement of physical parameters [GDPR, Art. 9, para. (2), lit. a)]. We store this data during the contractual period and 12 months after that. This data may be deleted, rectified or restricted at any time at your request. These data are accessed by our authorized employees, external providers of sports services (coaches, physical trainers, etc.) or providers of medical services (doctors, therapists, etc.), providers of center administration services and IT and archiving services. This data may be stored in encrypted format in another Member State.

3. All requests regarding the management of personal data can be communicated to us at gdpr@orhideeaspa.ro or at the address Orhideea Spa Health Foundation, Calea Plevnei 145B, SPA, Bucharest. In all communications you must specify your name, surname, personal numerical code (if it was collected), the address you want to be contacted and the problem you are reporting. In case there are doubts about your identity, we reserve the right to request additional information for identification [GDPR, Art. 12, para. (6)].

4. In the event that you are dissatisfied with the resolution of your requests, we inform you that you have the right to lodge a complaint with a supervisory authority for the processing of personal data. At the time of concluding this contract, in Romania, the legal entity is the National Authority for the Supervision of Personal Data Processing.
